Terms of Service

1. Who can use PicPorch

PicPorch is an online tool that edits real estate photos with artificial intelligence (AI) and creates related marketing materials, such as virtual staging, walkthrough videos, listing descriptions and tour links. It is meant for real estate agents, brokerages, property owners and managers, and other professionals marketing a property.

You must be at least 18 years old and able to enter into a binding contract. If you use the service for a company or brokerage, you agree to these Terms on its behalf and confirm you're allowed to.

2. Your account

Keep your login details private and tell us right away if you think someone else has used your account. You're responsible for what happens in your account. Give us accurate information and keep it up to date.

3. Plans, credits and payment

• One credit equals one photo edit (for example enhancing, decluttering, staging or twilight on one photo). Each edit includes the versions we show you to choose from.
• Subscription plans include a set number of credits each month. Unused plan credits don't roll over; they reset at the start of each monthly period (yearly plans also refill monthly).
• Credits bought with a Single listing purchase don't expire while your account is open.
• Some features have monthly limits shown on the pricing page (for example staged photos on Starter, or walkthrough tours).
• Prices are shown on our pricing page in US dollars. Taxes may be added where required.

Payments are processed by Stripe. For some purchases Stripe may act as the reseller and merchant of record, which means your card statement may show Stripe or our business name and Stripe's checkout terms also apply. We never see or store your full card number.

4. Subscriptions, renewal and cancellation

Subscriptions renew automatically at the end of each billing period (monthly or yearly) and your payment method is charged unless you cancel before the renewal date.

You can cancel anytime from Manage billing in your dashboard. Cancellation takes effect at the end of the current billing period; you keep access and remaining credits until then. Plan upgrades apply right away and may be prorated.

We may change our prices. If a change affects your subscription, we'll tell you in advance, and it applies from your next billing period. You can cancel before then.

5. Refunds

Because each photo edit uses paid AI processing as soon as it runs, used credits are not refundable. If something went wrong (for example a technical error or a charge you didn't intend), contact us within 14 days and we'll make it right, which may include restoring credits or a refund. Refunds may also be provided where the law requires or under the payment processor's policies.

6. Your photos and content

You keep ownership of the photos, videos and information you upload, and of the edited results we create for you (to the extent the law allows ownership of AI-assisted content).

You give PicPorch permission to store, process, edit and display your content only to provide and improve the service for you, including sending it to the service providers listed in our Privacy Policy. If you turn on a public tour link, the photos and video you choose can be viewed by anyone who has the link until you turn it off.

You confirm that you have the rights to everything you upload, including permission from the photographer and property owner where needed, and that it doesn't break any law or anyone else's rights. Don't upload photos showing people who haven't agreed to it.

7. AI edits: please review before you publish

PicPorch uses AI and is designed to keep each home true to life, but AI can make mistakes: it may change, add or remove details, or produce something inaccurate. Listing descriptions and captions are also written by AI.

• Check every photo, video and description before you use it, and fix or don't use anything that misrepresents the property.
• You are responsible for following your MLS rules, advertising laws and Fair Housing laws, including disclosing virtually staged or digitally altered photos where required.
• Don't use the service to hide defects or damage, or to make a property look different from how it really is.

8. Acceptable use

Don't use the service to:

• upload illegal, harmful, hateful, sexual or misleading content;
• deceive buyers, renters or anyone else about a property;
• copy, resell or reverse-engineer the service, or access it with bots or scripts other than our features;
• try to break, overload or get around the service's security or limits.

We may suspend or close accounts that break these rules.

9. Service changes and availability

We're always improving the service and may add, change or remove features. We aim to keep it running smoothly but can't promise it will always be available or error-free. Keep your own copies of anything important; download your photos and videos when they're ready.

10. Closing your account

You can stop using the service and ask us to delete your account at any time. We may suspend or end your access if you break these Terms or if we stop offering the service; if we end the service without cause, we'll refund any unused prepaid subscription time.

11. Disclaimers

The service is provided "as is" and "as available." To the fullest extent the law allows, PicPorch makes no promises or warranties about it, including that it's fit for a particular purpose, accurate, or that edits will be accepted by any MLS or website.

12. Limitation of liability

To the fullest extent the law allows, PicPorch isn't liable for indirect, incidental, special or consequential losses (such as lost profits, lost sales or lost data). Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim. Some places don't allow these limits, so they may not fully apply to you.

13. Indemnity

If someone makes a claim against PicPorch because of content you uploaded or how you used the service (for example a misleading listing or a copyright complaint), you agree to cover the reasonable costs of that claim.

14. Changes to these Terms

We may update these Terms. If the changes are important, we'll let you know by email or in the app before they take effect. Continuing to use the service after that means you accept the new Terms.

15. Law and disputes

These Terms are governed by the laws of the State of California, USA. Before starting any legal claim, please contact us so we can try to resolve it informally. Any dispute will be handled in the state or federal courts located in California, unless the law where you live says otherwise.
